General Terms and Conditions of Sale and Use (CGVU) for Tarot Fans Experts


1. Introduction and Acceptance of the Terms and Conditions


1.1. Platform Overview

Tarot Fans is an online platform managed by Undici Média (hereinafter referred to as "Tarot Fans," "we," "our," or "us") that connects experts with clients seeking remote consultation services.


1.2. Acceptance of the Terms and Conditions

By registering as an expert on Tarot Fans and using the services offered, you unconditionally accept these General Terms and Conditions of Use (CGVU). These CGVU constitute a legally binding contract between you (hereinafter referred to as "the Expert") and Tarot Fans. If you do not accept these terms, you may not use the platform's services.


1.3. Access to the Application

The Tarot Fans application is strictly reserved for adults, meaning individuals aged 18 or older. By using the application, you declare and guarantee that you are 18 years of age or older. If you are under 18, you are not authorized to use this application or access its services. Tarot Fans reserves the right to suspend or immediately terminate your account if it discovers that you do not meet the age requirement for using the application.


2. Registration and Profile Management


2.1. Account Creation

To become an expert on Tarot Fans, you must create an account by providing complete, accurate, and up-to-date information, including a valid email address, a secure password, and a professional profile picture.


2.2. Verification and Security

Tarot Fans reserves the right to verify the information provided during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.


2.3. Updating Information

You agree to keep all profile information up to date, including your rates, availability, and service descriptions. Any changes must be made through your personal space on the platform.


3. Platform Features


3.1. Consultations and Communication Modes

Tarot Fans allows experts to offer consultations through various communication modes:


  • Audio

  • Video

  • Chat

  • Live

3.2. Appointment Management

You can manage your appointments through the "Planning" section of your dashboard. Indicate your availability to allow clients to schedule appointments based on your calendar.


3.3. Online Store

Experts can create an online store on Tarot Fans to offer thematic consultations, special packages, and other personalized services. You have the freedom to set your own prices within the limits established by the platform.


3.4. Wallet and Payments

Each expert has a "Wallet" that allows them to view earnings generated from consultations, deducted commissions, and completed transactions. Payments are transferred to your Stripe account after deducting applicable commissions.


4. Pricing, Commissions, and Payments


4.1. Setting Rates

You have the freedom to set your own rates for each type of consultation, while respecting the minimum and maximum limits imposed by Tarot Fans. Rates may vary depending on the type of consultation and its duration. Experts can set their rates within the limits imposed by the platform:


  • Audio, video, and chat consultations: from 1€ to 15€ per minute

  • Live consultations: from 0.10€ to 1€ per minute

4.2. Commission Structure

Tarot Fans charges a commission on each transaction made through the platform:


  • 20% for Audio, Video, and Chat consultations.

  • 30% for Live sessions.

This commission is automatically deducted from the total amount paid by the client.


4.3. Payment Process

Payments are made to your bank account or the account of your payment provider, such as Stripe, as specified during your registration. You can view your earnings and deducted commissions in your "Wallet."


4.4. Chargebacks and Disputes

In the event of a payment dispute by a client (chargeback), the disputed amount, along with the corresponding commission, will be deducted from your "Wallet." Dispute reasons may include fraud, unfulfilled services, or poor service quality.


5. Appointment and Consultation Management


5.1. Appointment Scheduling

Clients can book appointments through your availability schedule. Once the appointment is confirmed, both you and the client will receive a "Pending" notification. You are required to honor the appointment at the agreed date and time.


5.2. Punctuality and Client Satisfaction

Punctuality is essential for maintaining a good reputation on the platform. Failing to attend scheduled appointments may result in complaints, negative reviews, and potentially sanctions from Tarot Fans.


5.3. In-Store Consultations

When a client purchases a consultation from your online store, the corresponding amount is locked in their "Wallet." You must respond quickly to their callback or appointment requests to avoid order cancellations.


5.4. On-Demand Consultations

If a client wishes to consult without a scheduled appointment after purchasing a consultation from your store, they can request a callback. You should respond as soon as possible to avoid the consultation being canceled.


5.5. Legal Status and Tax Obligations for Experts


For Experts Residing in France:


You must have a legal business status (Auto-entrepreneur, SASU, EURL, etc.).


You must comply with French tax and social regulations (URSSAF, taxes, etc.).


You are required to provide a tax certificate every three months through the application, under penalty of account suspension.


This certificate can be:


  • An URSSAF certificate (for auto-entrepreneurs).

  • An accountant’s certificate (for other business structures).

  • An official tax declaration (e.g., form 2042 C PRO).

For Experts Outside of France:


You must have a legal business status in accordance with the laws of your country of residence.


You must comply with the tax and social obligations applicable in your country.


There is no obligation for quarterly declarations on the application, but the expert remains responsible for their local legal and tax obligations.


6. Rights and Obligations of Experts


6.1. Code of Conduct

You agree to:


  • Provide high-quality consultations.

  • Respect the confidentiality of client information.

  • Maintain a professional and respectful attitude at all times.

  • Respond promptly to client calls and messages.

6.2. Legal Obligations

You must:


  • Hold all necessary licenses and authorizations required to practice your activity.

  • Comply with applicable laws, including those related to personal data protection (GDPR).

  • Not share illegal, defamatory, or rights-infringing content.

6.3. Intellectual Property

You retain the intellectual property rights to your content (texts, images, videos) published on the platform. However, by publishing on Tarot Fans, you grant Tarot Fans a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content as part of the platform’s operations.


7. Responsibilities and Limitation of Liability


7.1. Platform Responsibility

Tarot Fans is not responsible for interactions between experts and clients, nor for the quality of services provided by experts. The platform solely acts as an intermediary facilitating the connection. The Tarot Fans platform facilitates connections between experts and clients for remote services. However, Tarot Fans is not responsible for the content, topics, or advice exchanged between experts and clients. It is important to note that Tarot Fans does not record or listen to conversations, nor does it read written messages exchanged between clients and experts. Clients can report an expert and leave reviews on their profile. However, if an expert provides inaccurate predictions, discusses sensitive topics such as health, or engages in questionable practices, the platform cannot be held responsible. Tarot Fans takes reports seriously and reserves the right to ban experts if clients deem their practices suspicious or if services have not been delivered as agreed. Tarot Fans does its best to select high-quality, professional experts, but cannot guarantee against all potential risks, which shall not engage the platform's responsibility. In the event of a dispute, the client can only take action against the expert in their personal or business name.


7.2. Limitation of Liability

Under no circumstances can Tarot Fans be held liable for direct or indirect damages resulting from the use of the platform, including but not limited to financial losses, material or immaterial damages.


7.3. Ethical Commitments and Code of Conduct

The Expert agrees to adhere to a strict professional code of ethics to ensure a high-quality client experience. To this end, the Expert is strictly prohibited from:


  • Making promises or guarantees of results.

  • Expressing radical, extreme, or sectarian opinions related to religious, political, or esoteric ideologies.

  • Exerting psychological influence aimed at manipulating or inducing specific behavior in the client.

  • Addressing prohibited sensitive topics, including:

  • Health (medical diagnoses, prescriptions, or alternatives to medical treatment).

  • Finance and Investments (stock market predictions, financial advice, or wealth management).

  • Legality (encouraging illegal actions, false declarations, or fraud).

  • Life or Death (predictions about dramatic events concerning the client’s life or that of a third party).

  • Emotional Dependency and Psychological Abuse (emotional manipulation, pressure to extend a consultation).

  • Engaging in any form of fraud or exploitation of a client’s emotional or psychological distress.

  • Encouraging clients to schedule multiple consultations without valid reason or to incur debt to continue services.

7.4. Sanctions for Non-Compliance with the Code of Conduct

In the event of a breach of these rules, UNDICI MEDIA reserves the right to take immediate action, including:


  • Temporary or permanent suspension of the Expert's account.

  • Retention of funds in the Expert's Wallet in the case of proven abuse.

  • Reporting to relevant authorities in the case of illegal practices.

  • Permanent deletion of the Expert's account in the case of repeated offenses.

8. Modifications to the Terms and Conditions


8.1. Updates to the Terms and Conditions

Tarot Fans reserves the right to modify these Terms and Conditions at any time. Changes will be communicated to experts via their personal space on the platform or by email.


8.2. Acceptance of Modifications

By continuing to use Tarot Fans services after the publication of modifications, you accept the new terms. It is your responsibility to regularly review the Terms and Conditions to stay informed about any changes.


9. Account Termination


9.1. By the Expert

You can delete your account at any time through your profile in the "Settings" tab. Termination will result in the deletion of your profile and all associated data.


9.2. By the Platform

Tarot Fans reserves the right to suspend or terminate your account in the case of a violation of these Terms and Conditions, inappropriate behavior, or any fraudulent activity. In the event of termination, all unpaid commissions at the time of suspension will be withheld.


10. Personal Data Protection


10.1. GDPR Compliance

Tarot Fans is committed to complying with applicable regulations regarding the protection of personal data, including the General Data Protection Regulation (GDPR).


10.2. Data Collection and Use

The data collected during your registration and use of the platform is used to:


  • Manage your account and consultations.

  • Improve the platform's services.

  • Communicate with you regarding your activity on Tarot Fans.

10.3. User Rights

You have the following rights concerning your personal data:


  • Access: You can request access to your personal data.

  • Rectification: You can request the correction of inaccurate data.

  • Deletion: You can request the deletion of your data, subject to legal obligations.

  • Objection: You can object to the processing of your data in certain cases.

11. Governing Law and Jurisdiction


11.1. Governing Law

These Terms and Conditions are governed by French law.


11.2. Jurisdiction

In the event of a dispute concerning the interpretation or execution of these Terms and Conditions, the competent courts will be those of Cannes, France.

13. Use of iOS and Google Play Applications


13.1. Application Availability

The Tarot Fans application is available through the Apple App Store and Google Play Store, allowing users to download and use the application on their mobile devices. As an expert, you agree to comply with the general conditions imposed by these platforms for the use of available applications.


13.2. Payments and Transactions

All payments made by clients on Tarot Fans are exclusively managed by the platform's payment provider and Stripe, our secure payment processing partner. Neither Apple nor Google manage or directly receive payments for consultations or services sold through the application. Clients use their credit cards to make payments via the payment provider and Stripe, and these payments are transferred to your bank account or your Stripe account or dedicated payment provider account after the platform's commission is deducted. In-app purchases offered by Apple or Google do not apply to Tarot Fans services, as transactions take place outside the stores' payment systems.


13.3. Commission Structure

Tarot Fans charges a commission on each transaction made, in accordance with the Terms and Conditions. You can view your net earnings and deducted commissions directly from your "Wallet" on the Tarot Fans platform.


13.4. Responsibility of Undici Média, Apple, and Google

Undici Média: As the manager of the Tarot Fans platform, Undici Média facilitates interactions and connections between experts and clients, and ensures that payments are processed.


Apple and Google: Apple and Google only provide distribution platforms for the application and are not involved in payments or transactions processed by the payment provider. Experts acknowledge that these companies are not responsible for transactions or their management.


13.5. Refund Policies

Refund requests for consultations must be addressed directly to Tarot Fans and will be reviewed on a case-by-case basis in accordance with the Terms and Conditions. Apple and Google are not involved in the processing of refunds or financial disputes, as all transactions are processed through Stripe.


13.6. Application Updates

To ensure optimal performance, Tarot Fans may publish periodic updates through the App Store or Google Play Store. Experts are responsible for keeping their application up to date on their devices to access the latest features and avoid technical issues.


13.7. Device Compatibility

The Tarot Fans application is compatible with recent versions of iOS 12 and higher (for Apple devices) and Android 8.0 and higher (for Google devices). The use of the platform requires a compatible device.


13.8. Independence Clause

Undici Média specifies that Tarot Fans is an independent application, not affiliated with Apple or Google. These companies are not responsible for the services provided by Tarot Fans or for the services provided by experts.
